'Intentionally delaying': Duncan Hunter clings to House seat despite corruption guilty plea - Washington Examiner

A California Republican running to succeed Rep. Duncan Hunter says the GOP incumbent's departure is long overdue after he pleaded guilty to a federal corruption charge.

Hunter, 42, pleaded guilty on Dec. 3 to spending hundreds of thousands of dollars in campaign donations on personal expenses. Hunter said a few days later he would resign “shortly after the holidays,” but the San Diego-area lawmaker, first elected in 2008, did not specify a date.

That's not sitting well with Carl DeMaio, a Republican candidate to succeed Hunter in California’s 50th congressional district.

“By intentionally delaying his resignation past the deadline for the calling of a Special Election, Duncan Hunter is silencing the voice of the voters of the 50th District for a full year in Congress. He should have resigned as soon as he pleaded guilty,” DeMaio, a former San Diego City Council member, told the Washington Examiner in an email statement.

Since pleading guilty, Hunter has been unable to vote in the House, which meant he could not have a say in two articles of impeachment against President Trump passed on Dec. 18.

After a felony conviction of a member, party leaders usually pressure them to step down. But House Republican leadership and fellow California GOP members have not commented on Hunter’s delay in resigning.

If Hunter doesn't step down by the time the House returns to session on Tuesday, a member could call for a vote on a proposal to expel Hunter from the chamber. That's a rare punishment. The last time the House expelled one of its members was in 2002, when lawmakers forced out Democratic Rep. Jim Traficant of Ohio, after he was convicted of 10 felony counts that included bribery and racketeering.

The Washington Examiner reached out to House Republican leadership as well as the House California Republican delegation for comment.

DeMaio is one of several candidates running to succeed Hunter once he leaves office. Since California uses the "top two" system, it's possible a pair of Republicans will face off against each other for the seat.
